Will a West Palm Beach condo seller's right to rent transfer to me?

Last updated · 2026-10-26

Key facts

Rental amendment rule
Section 718.110(13) addresses amendments prohibiting rentals, changing rental duration or limiting rental frequency. Consent and acquisition timing matter.[1]
Recorded effectiveness
Section 718.110(3) makes a declaration amendment effective when properly recorded in the county's public records.[1]
Resale document rights
Section 718.503(2) entitles a contracted resale buyer to current governing documents, financial materials and the association's required question and answer document at the seller's expense.[2]
Local rental review
West Palm Beach requires a rental tax application and describes zoning review and code compliance inspection for rental properties.[5]

Separate the seller's position from your intended use

Ask why the seller is allowed to rent. The answer might be the ordinary declaration terms, a restriction adopted after the seller acquired title, or a disputed interpretation. Request the exact supporting provision rather than accepting a statement that the building is rental friendly. Describe your intended lease length, frequency and occupancy arrangement in writing so that the review concerns your plan. A history of tenants is a useful lead for investigation, but it does not answer the legal question for the next owner.

Have counsel identify which provisions affect the proposed acquisition. Prepare a comparison of the seller's claimed position, your intended use and the association's written explanation. Flag disagreements instead of choosing the answer that supports the purchase. Request the documents behind each interpretation and keep unresolved questions visible in the decision worksheet.

Build a recorded document trail

Request the declaration, all amendments affecting leasing, current bylaws and current rules. Identify the association's exact legal name and the unit's legal description. Follow the declaration's recording references into Palm Beach County Official Records and reconcile the versions supplied by the seller with the recorded instruments. Section 718.110(3) addresses recorded effectiveness. Keep the instrument reference and the complete document together, including exhibits, rather than relying on an isolated paragraph or an undated rules summary.

The Clerk's portal allows free searches, document viewing and printing of uncertified copies. Its disclaimer warns that online information can be incomplete or outdated and is not a title determination. Treat it as a discovery and cross checking tool. Ask your title provider or counsel to resolve gaps, conflicting amendments and the relevant ownership chronology. A search result showing a document was recorded does not decide whether the amendment was validly adopted or how it applies to your transaction.

Obtain a current association package

Use the resale disclosures in Florida Statutes 718.503(2) as the starting package. Contracted resale buyers are entitled to current governing documents, financial disclosures and the required association question and answer document, along with applicable inspection and reserve materials. Request them early enough for meaningful review within your transaction's deadlines. Have counsel identify the applicable delivery and cancellation provisions rather than borrowing a deadline from a different kind of sale. Receiving a package does not establish that it answers every rental question.

DBPR lists current association rules, meeting minutes and governing document amendments among association records. Ask the seller to obtain relevant material through the proper owner access process. Ask about adopted changes, pending proposals and written leasing procedures. Separate what the documents require from what a manager recalls. Seek a written response identifying the provisions the association believes will govern your ownership. That response is useful evidence for review, but it does not replace the governing documents or resolve a legal conflict by itself.

Check approval steps and government requirements separately

Create a checklist from the documents for any waiting period, minimum lease term, rental frequency limit, application, screening or approval requirement. Leave an item unresolved if the supplied material does not answer it. DBPR explains that association transfer fees depend on governing document authorization and approval requirements. Request the current application and fee schedule without assuming that the seller's previous approval or payment covers a future lease. Avoid building projected income around approval that has not been established.

Association permission and government requirements are separate checks. West Palm Beach's rental guidance addresses both short term rentals and designated tenants, with a rental tax application, zoning review and inspection process. Confirm the parcel is actually within the city's jurisdiction before applying that guidance. For vacation rental plans, review DBPR's separate licensing guide and the site's dedicated local approvals answer. An association's permission does not establish local compliance, and a government license does not settle private condominium restrictions.

Make the purchase decision from your verified position

Give counsel the complete records, the proposed ownership structure and your intended rental plan. Ask for a clear account of applicable restrictions, remaining uncertainties and any transaction protections worth negotiating. If the unit is already occupied, request the actual lease and amendments and have counsel review the existing tenancy separately from your ability to enter a future lease. Do not treat current rent receipts as a forecast of legally available future income. Resolve material gaps before relying on a rental budget to justify the purchase.

What the records cannot show

  • A seller's rental history does not establish the buyer's future rental permission or income.
  • A public recording does not by itself resolve amendment validity, enforceability or a disputed interpretation.
  • A general statute cannot establish approval, future rule changes or compliance for a particular unit.

FAQ

Frequently asked questions

Does a seller's grandfathered rental status automatically transfer?
Do not assume it does. Have counsel apply the recorded restrictions and statutory acquisition timing rule to your purchase.
Does the seller's existing tenant prove I can sign a new lease?
No. Review the existing tenancy and future leasing permission separately. Request the executed lease, association requirements and applicable recorded restrictions.
Which documents should I request?
Obtain the current declaration, amendments, bylaws, rules and association question and answer document. Ask for the current leasing application and written clarification of the provisions applicable to your proposed ownership.
Does association permission replace a city rental license?
No. Review West Palm Beach's rental application, zoning and inspection requirements separately, and check state licensing if your intended activity is a vacation rental.
