Separate a closing requirement from a need for advice

Florida Statutes 627.7711 defines closing services to include preparing necessary closing documents, conducting the closing and disbursing funds in a transaction involving a title insurance commitment or policy. Licensed title providers can perform those functions. That is the basis for distinguishing an ordinary closing from a legal representation engagement. The existence of a closing agent does not establish that a buyer has retained counsel to negotiate or interpret the purchase contract.

Use the question you need answered to decide the scope. A request for the balance required at closing is different from a request about whether you can terminate without losing a deposit. If the decision turns on your legal rights, obtain advice from a Florida attorney who has agreed to represent you. Ask whether the proposed engagement includes contract review, title objections, association documents and closing attendance. This is a practical decision framework, not a claim that every purchase requires each service.

Obtain review while the contract can still protect you

Before signing, identify the obligations you do not understand and the protections you need written into the agreement. Useful review questions include who bears an assessment, what happens if financing fails, what condition must exist at delivery, and how an objection or cancellation must be delivered. These are issues to place in the review scope, not assumptions about protections that every contract supplies. Send the entire agreement, addenda and relevant correspondence so the advice addresses the actual transaction.

Escalate a disagreement about a deposit before treating a cancellation email as a refund authorization. The Department of Financial Services explains that a title agency holding disputed escrow funds generally needs the parties' written approval to release them, with a court process available when agreement fails. A legal entitlement and the escrow holder's authority to disburse are different questions. Keep notices, delivery evidence and the contract together. Do not rely on a verbal assurance that an objection can be resolved after closing.

Understand what title insurance and title work provide

The Department of Financial Services distinguishes an owner's policy, which protects the buyer's interest, from a lender's policy, which protects the lender. Policies contain exclusions. Request the commitment, its requirements and exceptions, and the proposed coverage before committing to close. Identify anything that affects the intended use of the property, such as a restriction or easement, and ask what remains outside the policy. Insurance against covered title loss is not a general assessment of whether the purchase terms serve your interests.

The statute separately defines primary title services as evaluating insurability, resolving underwriting requirements and issuing the commitment and policy. Those tasks can help identify defects that must be addressed for insurance. They do not make every contract, boundary, ownership or use question disappear. Where a requirement is unresolved or an exception matters to your plans, have the responsible title provider explain its treatment and have your counsel assess the legal consequences. Confirm which person is responsible for each unresolved item before funds are released.

Treat condo documents and cancellation clocks as a legal review

For a West Palm Beach condo resale, Florida Statutes 718.503 gives the purchaser rights to specified documents at the seller's expense. They include the declaration, association articles, bylaws and rules, annual financial statement and budget, and additional inspection and reserve material as applicable. Review the actual documents with the proposed contract. A summary of monthly dues cannot answer whether use restrictions, maintenance obligations or assessment provisions fit the purchase.

The nondeveloper resale provisions use a 7-day review framework excluding Saturdays, Sundays and legal holidays, tied to contract execution and receipt of the specified documents. That matters when a buyer encounters an unusual deed, an ownership mismatch or a proposed correction. Downloading a form is not a determination that the form accomplishes the intended transfer.

The Clerk's online Official Records disclaimer also warns about incomplete or inaccurate indexing and explains that some records are provisional or unavailable online. An empty search result therefore cannot prove that title is clear. Preserve the instrument references you find and send them with the title commitment and survey for the appropriate professional review. Ask counsel to state remaining legal issues and ask the closing provider which requirements remain open. Keep that written issue list separate from the inspection findings, insurance quotes and ownership budget.
