Due Diligence

What city approvals and state licenses should I check before buying a West Palm Beach home for short term rentals?

Last updated · 2026-10-12

Key facts

Published city minimum
The city rental application revised September 15, 2025 describes vacation rentals as rented or available for rent for a minimum of 7 consecutive days.[2]
Local review
City guidance requires a zoning review and code compliance inspection for rental properties, with a fire inspection if 3 or more units are under the same roof.[1]
State licensing trigger
DBPR guidance requires a license for a whole unit rented more than 3 times in a calendar year for periods under 30 days or 1 calendar month, whichever is less, or advertised for regular transient rental.[3][4]
Ownership change
The city application states that certificates of use are not transferable.[2]

Start with the parcel and the city review

Identify the parcel and confirm that the property is inside West Palm Beach city limits. Give Development Services the address, unit configuration, intended guests, rental duration and whether you will occupy the home. Ask for the rental classification and applicable zoning requirements in writing. This is a purchase diligence request, not an assumption that a seller's existing rental activity establishes permission for your operation.

The city's Rental Property Guidelines require a rental tax application, zoning review and code compliance inspection. They also identify a fire inspection when 3 or more units are under the same roof; the application's fee schedule excludes condominium fire inspections. Confirm the applicable scope with the city. The application describes issuance of the tax receipt and certificate of use after prerequisites are completed. Request existing approvals and inspection records, then ask what a new owner must obtain. The same application says certificates of use are not transferable.

Match the state license to the actual rental model

DBPR distinguishes renting a whole dwelling from renting a room. Its guidance says renting individual rooms rather than the whole unit does not require its public lodging license, while local requirements can still apply. For whole units, check the transient rental trigger rather than relying on a platform's description of the property. Florida Statutes 509.013 defines transient public lodging using rentals more than 3 times in a calendar year for periods below 30 consecutive days, or advertising for regular rentals below that duration.

The department licenses vacation rentals as dwellings or condominiums, depending on the property. Use its public Vacation Rental Database to verify the specific rental address. Obtain clarification about the proposed operator and ownership change instead of treating a seller's license as yours. Review safety obligations with the appropriate authorities before hosting.

Resolve rental duration and private restrictions separately

The currently linked city application, revised September 15, 2025, describes a minimum vacation rental period of 7 consecutive days. Treat that published language as a reason to obtain a parcel specific determination before underwriting nightly stays. Florida Statutes 509.032 generally restricts local prohibitions and regulation of vacation rental duration or frequency, but excepts local measures adopted on or before June 1, 2011. This page does not establish which historical city provisions control your parcel or decide their enforceability.

Association documents need a separate review. Under section 718.110, condominium rental restriction amendments can apply to buyers who acquire title after the amendment's effective date, even if the seller was protected. Section 720.306 also permits HOA amendments restricting rentals shorter than 6 months and rentals more than 3 times per calendar year to apply to all owners. Ask counsel to review the recorded declaration, amendments and current rental rules together.

Check rental taxes as well as operating approvals

Rental tax registration serves a different purpose from zoning and lodging licensing. Florida Department of Revenue guidance applies the 6% state sales tax, plus applicable discretionary surtax, to taxable accommodation rentals of 6 months or less. It requires registration to collect, report and remit tax, with each place of business separately registered. Ask who will handle reporting and confirm the account arrangements for your operation.

The Palm Beach County Tax Collector requires a Tourist Development Tax account and a county Short Term Rental Local Business Tax Receipt for each vacation rental TDT account. Its guidance requires the account and receipt numbers in online advertising and says hosts must collect and remit the county tax because online platforms do not remit it to the county. Confirm the current tax treatment directly with the agencies. A booking platform's collection statement does not resolve the separate registrations, reporting duties or local approvals.

Make the purchase decision depend on verified use

Build a diligence file containing the city's written response, existing rental and certificate records, inspection findings, applicable DBPR information, tax registration requirements and association restrictions. Match each document to the property and the intended buyer. Ask counsel to address unresolved use questions and suitable purchase contract protections before the diligence period expires. If an approval is pending, describe it as pending in the financial plan.

Also check the tax consequences of renting a home you intend to claim as homestead. Section 196.061 treats rental of all or substantially all of a homestead as abandonment, subject to its timing provisions and exceptions. Ask the Property Appraiser how your intended occupancy and rental pattern affect eligibility. Operating approvals do not establish rental demand, obtainable nightly rates, insurance coverage or net income. Those require separate evidence and property specific review.

What the records cannot show

  • A DBPR license record alone does not establish compliance with city zoning or association restrictions.
  • The city application does not establish the legality of every proposed stay length or decide the effect of historical ordinances on a specific parcel.
  • A seller's approvals do not establish the approvals, tax accounts or private rental rights available to a new owner.
  • Public licensing records do not establish achievable rental income, insurance coverage or physical condition.

FAQ

Frequently asked questions

Does a DBPR license replace city approval?
No. West Palm Beach's rental application requires local zoning review and applicable inspections. Check those requirements and private restrictions separately from state licensing.
Can I rely on the seller's certificate of use?
The city's published application states that certificates of use are not transferable. Request the existing file and confirm the new owner's requirements with Development Services.
Can I assume nightly rentals are allowed?
No. The published city application describes a minimum of 7 consecutive days. Obtain written confirmation for the parcel and intended use, including the effect of any applicable historical ordinance and association restriction.
Does a booking platform handle every rental tax obligation?
Do not assume that. The county Tax Collector says hosts must collect and remit its Tourist Development Tax and that online platforms do not remit it to the county. Check state registration and reporting separately.
